The Brady Bill passed the House of Representatives by a vote of 238 for, 189 opposed. The bill makes progress toward protecting the civil rights of law-abiding citizens who purchase handguns -- by adoption of the Ramstad and Gekas amendments. We are encouraged that the waiting period will cease to exist in 5 years for a system that is recognized by both sides as the superior system, the point-of-purchase "instant check". The Ramstad Amendment calls for law enforcement to make known to a rejected handgun purchaser the reasons for that denial within 20 days. The Gekas Amendment sets a time certain for the implementation of the instant check, 5 years. The Amendment passed 236 for, 198 opposed. Sarah Brady has already stated that there will be an effort to ensure that this amendment never gets enacted. The five states that currently have an instant check (Virginia, Delaware, Wisconsin, Florida, Illinois) in place, Brady will have no effect. The McCollum amendment failed to win approval and shows that the House of Representatives is not interested in protecting all citizens of this nation equally under the law. The McCollum amendment would have required that when the instant check comes on-line all state waiting period provisions would be preempted. States that have other provisions, such as mandatory training, fingerprinting, or one gun a month would not have been affected. The proponents of the bill have said that we need uniform national laws but when it came time to count the votes what they really wanted was a patchwork of laws from state to state. The amendment failed 176 for, 257 opposed. No one should make the mistake that the bill will do anything about violent crime if it is enacted. The bill ignores the overwhelming majority of criminals who obtain firearms illegally. The bill only affects the retail firearms dealer -- it will have no effect on repeat violent criminals or juvenile gang members who routinely obtain their il;legal guns on the black market. The Senate will most likely take up the Brady Bill in the beginning to next week. You can help by calling your Senators and urging them to vote NO on the Brady Bill. Before it was defeated, it was modified by unanimous consent. The modification clarified that the provisions of the amendment apply to States or political subdivisions that impose a waiting period before the purchase of a firearm can be completed.
