From: [br 048] at [cleveland.Freenet.Edu] (Guy Rosa) Newsgroups: talk.politics.guns Subject: Brady Law in Montana - NOT! Date: 17 May 1994 14:17:26 GMT From the Bloomberg Newswire: Helena, Mont., May 16 (Bloomberg) -- A U.S. Federal judge ruled part of the Brady gun law unconstitutional, the Associated Press reported. US District Judge Charles C. Lovell ruled against the law's requirement that local authorities check the background of anyone applying to buy a firearm. (Should be 'handgun' -Guy) The Montana judge left intact the law's provision for a 5 day waiting period befor a gun may be bought. But checking during that time to ensure the customer isn't a minor, a criminal, or doesn't have a history of drug, alcohol, or mental problems, he ruled, violated the constitution's limits on federal power over the states, the report said. A professor of constitutional law at the Univ. of Montana told the AP the ruling would not necessarily apply outside the state. THe final decision on the various conclusions reached by federal courts on the law would be up to the U.S. Supreme Court, he said. The law was designed to reduce the number of crimes involving firearms in the United States. (NOT the number of crimes, just crimes w/firearms! - Guy) It was named after James Brady, the press sec'y under former President Ronald Reagan, who suffered brain damage after being shot during an assassination attempt against Reagan. -- "If we stack sufficient option delta, it completely neutralizes movement in the price of the hedged instrument."
