At a news conference in August to launch the Dehere Foundation, Brennan said his 23 year old brother, Kevin was murdered in 1969 by a robber with an illegal handgun. Kevin Brennan, however, was killed May 17, 1969, at the end of a chase along the Garden State Parkway by three Middlesex County sheriffs officers. Rudolph Johnson, now the warden of the Middlesex County Adult Corrections Center, was the sheriff's officer who fired the fatal shot at Kevin Brennan. He called the shooting "an unfortunate situation" and "nothing I'm proud of" but said he shot after Brennan pointed what turned out to be a starter's pistol at the other two officers. Johnson expressed shock, at hearing Robert Brennan's version of the story. "That's incredible," Johnson said, "It puts me in a position where I've got to get in another argument with the family after 23 years." A grand jury sharply criticized the behavior of the officers and their superiors at the time.
