I'm only passing this on. -- JM] John Wallner, the organizer of the San Diego Militia, had a brief meeting with San Diego Sheriff Jim Roache at the end of May. Wallner explained the structure and goals of the Militia to Sheriff Roache, and gave him copies of the group's literature. The Sheriff reacted positively -- he wished the SDM good luck in achieving its goals, and gave assurance that so long as the SDM remained law abiding, there is nothing to fear from the Sheriff's department. When Roache was asked to volunteer for the Militia, he indicated he would give the matter some thought. Of course, Jim Roache was voted out of office on June 7. Welcome to the first issue of the San Diego Militia, the official newsletter of the San Diego Militia! If you receive this newsletter, it is because you signed a sign-up sheet, or someone else submitted your name. The San Diego Militia was announced on May 11, 1994. Within 24 hours, 50 volunteers had signed up or expressed interest. And queries are still pouring in! We hope that by organizing the San Diego Militia, we can file actions in the Federal Courts which will provide the Second Amendment with teeth. After the Militia has been in existence for at least a year, some of our legal-eagles will file court cases requesting federal sanction under the Second Amendment. From there, we can incrementally restore our firearms rights. This approach is similar to that used by the NAACP in successfully defeating racial segregation. The initial goals of the San Diego Militia are: + Advocate a broad interpretation of the Second Amendment Right to Keep and Bear Arms; + Provide low or no-cost firearms safety education to the general public; + To educate the public about firearms; + To educate members on applicable firearms laws; + To influence pending firearms legislation; + To learn and practice military style parade drill, and to perform in community parades and special functions; + To promote safety and responsibility among gun owners; + To serve our community. Note that we will NOT be engaging in any vigilantism or law enforcement activity. The San Diego Militia, and it's members, shall comply with all applicable State and Federal laws at all times. Questions About the Militia The following are some common questions about the Militia: Q) Is forming a Militia against state Law? A) No. California Penal Code s 11460 prohibits "paramilitary organizations", which are defined as "an organization ... which engages in instruction or training in guerrilla warfare or sabotage." Since the San Diego Militia and its members shall abide by all state and Federal laws, this statute does not prohibit our existence. Q) How does Federal law define a militia? A) Federal Law 10 USC 311(a) states that the militia consists of all able-bodied males between the ages of 17 and 45. The militia is classified into 2 parts: the "organized" militia consists of the National Guard, and the "unorganized" militia consists of everyone else. Q) How is the militia organized? A) The militia will be organized as a not-for-profit corporation. Q) Can women join? A) Yes. Our first volunteer was a woman! Q) Are there requirements for membership? A) Yes. Members must be citizens of the U.S., have no criminal record, and must sign a declaration stating they do not advocate the overthrow of the U.S. government. Drilling members must have completed a firearms safety course, or have a military background. Drilling members must also supply their own rifles for parade drill. Q) Can I join without participating in the parade drill? A) Yes. The Militia has need of volunteers to man phone trees, store supplies (such as banners and costumes), to stuff envelopes, and to publish this newsletter. Q) How often will the Militia meet? A) Once a month, on weekends. Q) Does it cost anything to join? A) No, membership is free. All that is required is a desire to meet once a month, and enjoy the company of your fellow Militiamen!
