Mr. Marc Halcon of San Diego (CA) Firearms Academy has announced a Constitutional Challenge to the Omnibus Crime Bill and the Brady Bill. He is bringing suit against Attorney General Janet Reno and the United States of America. The following is a summary of the Constitutional Challenges: a. Second Amendment (right to keep and bear arms) b. Article I, Section 1 (i.e., unconstitutional delegation of legislative power to the executive branch) c. Fifth Amendment: 1. taking of property without just compensation 2. due process (i.e., vague, over-broad) d. Article I, Section 8 (i.e., no legislative authority) e. Article I, Section 8 (i.e., no power to regulate under interstate commerce clause) f. Ninth Amendment: 1. implied right to self defense, defense of family, and defense of property 2. natural right to self defense, defense of family, and defense of property g.
