Date: Tuesday, September 14, 1993 3:41AM California Forfeiture Statute "Sunsets" The battle over California's asset forfeiture statute has ended, at least for a while, with F.E.A.R. (Forfeiture Endangers American Rights) coming out victorious. On January 1, 1994, the controversial confiscation law will expire, leaving police and prosecutors with an older, less oppressive forfeiture law to use. The expiring law permitted the state to confiscate homes, cars and life savings from people who were not convicted of a crime. The older law will require the state to prove people guilty of committing a crime before being able to permanently divest them of their property. California Attorney General Dan Lundgren fought hard to get SB- 1158, a bill that would extend the current forfeiture law, passed before the law's expiration date, but the state legislature wasn't buying. F.E.A.R. was successful in demonstrating how unfair Lundgren's bill was and nearly got a sweeping reform bill (AB-114) enacted instead. Lundgren has pledged to reintroduce his forfeiture bill in 1994. Likewise, the California chapter of F.E.A.R. has promised to reintroduce it's reform bill. Stay tuned!
