In answer to your question, it is our position that the Second Amendment means what it says. It say that the people's right to keep and bear arms shall not be abridged. Samuel Adams, in commenting on that amendment said: "And the said Constitution be never construed to authorize Congress.. to pervert the people of the United States who are peaceable citizens, from keeping their own arms." Unfortunately, there have been court decisions that have whittled away at what was clearly intended to be an absolute right. At this point, the state of Constitutional law is that Congress may make some laws restricting the right to keep and bear arms. Those decisions are simply wrong and bespeak a court unwilling or unable to take into consideration the clear intention of the framers. One of our Affiliate Attorneys is in the General Counsel's office of the National Rifle Association. Although I am not a member, I support their work. However, we are not involved with any litigation in this area and do not anticipate becoming involved in any this year. As a young organization, we have limited resources and are devoting those resources to First Amendment issues at this time. As time goes on, however, we expect to expand our operation to litigation involving property rights as well as the right to keep and bear arms. Thank you for your letter. I wish you the best of luck.
