The Clinton administration is about to take an unpopular and untenable position: on Friday, October 1, at 2:00 pm, the U.S. Court of Appeals for the D.C. Circuit will hear oral arguments in NORML, Alliance for Cannabis Therapeutics, and Drug Policy Foundation v. DEA. The lawsuit in question argues that marijuana should be rescheduled from Schedule I to Schedule II (that marijuana, like morphine, has medical utility),. The government has argued that marijuana should remain in Schedule I (that marijuana has no medical utility whatsoever). On Friday, NORML will be asking for the opportunity to present evidence to appeal the DEA's previous decision not to reschedule marijuana. If the ruling from tomorrow's case goes in NORML's favor, it will not -- in and of itself -- reschedule marijuana. the release goes on, but here is my personal update >>>>>>>>>>>>>>>>>. We had hoped that Janet Reno and the DEA would simply drop their opposition but they did not. They did show up in court on Friday and arguments *are* being scheduled.
